Regulations of the margotte.pl online store
The following Terms and Conditions define the rules for concluding distance sales contracts and the rights and obligations of the Seller ("Store") and Customers/Consumers, in accordance with applicable Polish law (in particular the Act of 30 May 2014 on Consumer Rights) and the EU GDPR Regulation (EU 2016/679). Sales are conducted in Polish; the contract is concluded in Polish.
§1 Definitions
- Consumer – a natural person who concludes a legal transaction with an entrepreneur that is not directly related to his or her business or professional activity.
- Seller (Store) – entrepreneur Małgorzata Tromska, conducting business under the name Małgorzata Tromska, identified by the Tax Identification Number (NIP): 7851821108, and National Business Registry Number (REGON): 541713600, with its registered office in 63-100 Śrem, ul. Kilińskiego 24 B/1, operating an online store at margotte.pl .
- Goods – products offered in the Store (clothing, jewelry, home decorations, etc.).
- Sales Agreement – a distance contract concluded between the Seller and the Customer, in which the Seller undertakes to transfer ownership of the Goods to the Customer and the Customer undertakes to pay the agreed price.
- Distance contract – a contract concluded using means of distance communication (e.g. the Internet).
- Regulations – this document.
§2 Conclusion of the contract
The sales contract is concluded upon the Seller's confirmation of acceptance of the Customer's order. The Seller confirms acceptance of the order on a durable medium (e.g., email) before processing the order.
§3 Prices and payments
- All prices listed in the Store are gross prices (including VAT) and are expressed in Polish zloty (PLN) or in Euro on the English website.
- Payments in the store are made via payment platforms available on the website.
- The condition for the order to be fulfilled is payment of the full price of the Goods and any delivery costs before shipment.
§4 Delivery
- The Seller delivers Goods within Poland via Inpost to a parcel locker. Within the rest of the European Union, delivery is via DPD to the address provided by the customer.
- Delivery costs and times are provided when placing the order and on the Shipping Policy page.
§ 5 Right of withdrawal
The consumer has the right to withdraw from a distance contract without giving any reason within 14 calendar days from the date of receipt of the order, in accordance with the Act of 30 May 2014 on consumer rights.
In order to exercise the right of withdrawal, the Consumer is obliged to inform the Seller of his decision by e-mail to the following address: margotte.help@gmail.com before returning the product.
The returned product must be in pristine condition, meaning it must not show any signs of use. Proof of purchase (receipt) must be included with the shipment.
The cost of returning the product is borne by the Consumer.
The Seller shall refund all payments (including delivery costs) no later than 14 days from receipt of the declaration of withdrawal or proof of its sending.
If the consumer withdraws from the contract, the Seller will refund all payments received from the consumer, including delivery costs, but not more than the cost of the cheapest delivery option offered by the Seller. The cost of returning the goods is borne by the consumer. Refunds will be made using the same payment method used by the consumer in the original transaction, unless the consumer expressly agrees to a different refund method that does not incur additional costs.
Custom-made products, including Style Bundles and personalized jewelry, are not eligible for returns, in accordance with Article 38 of the Consumer Rights Act.
§ 6 Complaints
The consumer has the right to file a complaint in the event of non-conformity of the goods with the contract within 2 years from the date of receipt, in accordance with the provisions of the Act of 30 May 2014 on consumer rights.
A complaint may concern, in particular, situations where:
– the product has a physical defect that was not indicated in the description;
– the product does not match the description;
– there was an error in the execution of the order.
The Seller may refuse to accept the complaint if:
– the defect results from normal wear and tear of the item;
– the damage was caused by the Consumer’s fault;
– the item’s shelf life has expired.
If the complaint is accepted, the Seller may, in agreement with the Consumer:
– refund the full price of the product and optionally ask for it to be returned,
– refund part of the price without having to return the goods,
– repair or replace the product at no additional cost to the Consumer.
The costs of shipping the complaint are covered by the Seller, provided that the complaint is accepted.
The Seller is obliged to inform the Consumer within 14 days of receiving the complaint about the manner of its consideration (accepted/rejected), in accordance with Article 7a of the UoPK.
If the consumer withdraws from the contract, the Seller will refund all payments received from the consumer, including delivery costs, but not more than the cost of the cheapest delivery option offered by the Seller. The cost of returning the goods is borne by the consumer. Refunds will be made using the same payment method used by the consumer in the original transaction, unless the consumer expressly agrees to a different refund method that does not incur additional costs.
Complaints should be reported by e-mail to the following address: margotte.help@gmail.com, together with photographic documentation of the goods complained about.

§9 Final provisions
- The Seller reserves the right to change the Terms and Conditions. Changes will take effect 7 days after publication.
- In matters not regulated, the provisions of the Civil Code and the Consumer Rights Act shall apply.
- The contract is subject to Polish law, the language of the contract is Polish, and disputes will be resolved by the court having jurisdiction over the Seller's registered office.
